Unfortunately, having read your excellent website information, I am the not so proud owner of a memory foam mattress from Benson Beds ( it is a Relyon brand).

I say unfortunate, because we now have a ‘mountain ‘ range along the middle of the mattress.

Having complained, and had an ‘independent’ inspection, I am informed that it is not a manufacturing fault.

I was at no point told about ‘settlement’ as it is termed, when we bought it.

Is this miss-selling, and is there anything I can do about it under the Sale of goods act.

The mattress cost £400 and is under 12 months old.

Hi Greg.

 

Thank you for your question and we are sorry that you have had problems with regard to your existing mattress.

 

Settlement or indents do tend to show themselves in mattresses that have a larger area such as kingsize or superking.  This is due to the fact that the middle of the mattress is not being utlised fully.   This is why we always recommend having a mattress that can be flipped over and rotated on a monthly basis as this then allows for the whole of the mattress area to be utlised and allows the fillings to settle evenly.  We also recommend that with a superking mattress, one person sleeps in the middle of the mattress at some point as this then prevents a ridge from forming.

 

Indentations in a new mattress do form particularly in the first few weeks/months of sleeping on a mattress which is why it is important to turn and rotate the mattress monthly as this will then allow the fillings to settle evenly.   This process can take up to about 12 months.

 

 

A fault in a mattress would show as an indentation of more than 2cm.  Settlement itself is not an indication that a mattress has failed.
